  1. Who we are

We are Betfair International Plc, a company incorporated in Malta (company number C 52779) with registered address at Level 2, Spinola Park, Mikiel Ang. Borg Street, St. Julians SPK1000 Malta. We are part of Flutter Group.

  1. Our license details

We are licensed to provide Real Money Games (fixed-odds betting, exchange betting and casino) in Romania by the National Office for Gambling ("ONJN") under license to organize number L1160655W000329.

YOUR CONTRACT WITH US

  1. The contract between you and us

3.1 The General Terms apply to your access and use of the Services. By clicking to accept the General Terms, or otherwise accessing or using any part of the Services, a contract is created between you and Betfair and you are confirming that you have read and understood and will be legally bound by the General Terms.

3.2 Not all of the legal terms and conditions that apply between you and us are set out in the body of the General Terms -- some of them are contained in separate documents in order to avoid the General Terms becoming too long and cumbersome. We cross-refer to these other documents and provide you with links to them at the appropriate places throughout the General Terms (including in Section 3.3 below). They are nevertheless important terms and conditions which form part of the General Terms and therefore the legal contract between you and us, and you should read and understand them just like the rest of the General Terms .

3.3 By clicking to accept the General Terms, or otherwise accessing or using the relevant part(s) of the Services, you are also confirming that you have read and understood, and you will be legally bound by, the following additional terms and conditions:

3.3.1 Sportsbook Rules , which apply when you use our Sportsbook Services;

3.3.2 Exchange Rules , which apply when you use our Exchange Services;

3.3.3 Charges Rules, which apply when you use certain Exchange Services;

3.3.4 specific Game rules, as set out in-Game and/or on each Game's information page on the Website;

3.3.5 Betfair Forum Terms, which apply when you use our Betfair Forum chat forum Services;

3.3.6 Live Video Terms, which apply when you use our live video streaming Services; and

3.3.7 in relation to promotions, our Standard Promotion Terms and any Specific Terms relevant to the individual promotion displayed on the Website, Gaming Platform or other communication (such as email);

If you don't agree to the General Terms or any part of them, including any of other the terms and conditions which form part of the General Terms (such as those listed above) or any part of them, you shouldn't access or use the Services or the part(s) of the Services to which they relate .

  1. Changes to the General Terms

4.1 We may change the General Terms from time to time for various reasons including commercial reasons, to comply with law or regulation, to comply with instructions, guidance or recommendations from regulatory bodies, or for customer service reasons (e.g., to keep up to date with any changes to the Services). We will tell you about any significant changes to the General Terms before they take effect.

4.2 If you don't agree to the changes then you should stop using the Services and you may request a withdrawal of any positive balance on your Account. We will process that request unless we have a right to delay the withdrawal, void any related transactions, or recover or not pay out any balance, winnings, funds, rewards or other credits under the General Terms. You will be deemed to have accepted the changes if you don't take this action or you continue to use the Services after the date the changes take effect.

4.3 We encourage you to visit the Website regularly to check the version of the General Terms in force at that time.

8.2 For various legal, regulatory, commercial and/or other reasons, we do not permit Accounts to be registered by persons who are located in Prohibited Territories, and we do not permit Accounts to be accessed or used (either deliberately or accidentally) while in any Prohibited Territories. You must not access or use or attempt to access or use your Account while you are in any Prohibited Territories.

8.3 If you are a resident of another nation and you move or travel to any of the Prohibited Territories, you may request a withdrawal of any positive Account balance. We will process that request unless we have a right to delay the withdrawal, void any related transactions, or recover or not pay out any balance, winnings, funds, rewards or other credits under the General Terms.

8.4 You must not bypass (or attempt to bypass) any measure we may use to prevent or restrict access to or use of the Services or to detect or correctly identify the location from which you are accessing or using the Services. For example, you must not use a VPN to disguise your location or seek to disguise or interfere with the IP address of the device you are using to access the Services.

  1. Funding your Account

9.1 To bet and/or to play Games for real money via the Services, you need to deposit funds. The currencies and methods available for deposit of funds can be found by logging into your Account and clicking "Deposit". For more information about deposit methods, including any charges relating to the deposit of funds, if applicable, see here.

9.2 Part B Section 4 and Part B Section 5 explain the Deposit Requirements and general rules about deposits and balances. In addition, as part of our commitment to responsible gambling, we offer you the possibility to set daily, weekly and / or monthly deposit limits.

9.3 All funds deposited to your Account should be used for betting and wagering. We will, where appropriate, ask you to comply with Verification Requests to check you meet this requirement.

9.4 We may at any time set off any amount on deposit in your Account against any amounts owed by you to Betfair.

  1. Requesting a withdrawal

10.1 The methods available for withdrawing your funds can be found by logging into your Account and clicking "Withdraw". Withdrawal and return processing methods and times vary according to the type of payment method used and applicable law/regulation. For more information about withdrawal methods and processing times, including any charges relating to the withdrawal of funds, if applicable, see here.

10.2 You may request a withdrawal from your Account at any time, subject to any applicable regulatory requirements. Part B Section 8 explains how withdrawals and returns are processed and when they may be delayed.

10.3 Funds you withdraw from your Account may be subject to taxation under Romanian law and regulations.

  1. Prohibited Events -- when we will void transactions and recover or not pay out winnings

11.1 Part B Section 13 explains what the Prohibited Events are, and Part B Section 14 explains when we will restrict, suspend or close your Account for Prohibited Events. If we discover or determine (acting reasonably) that you have engaged in any Prohibited Event then

11.1.1 we will: (a) void any transactions (such as bets); and/or (b) withhold all or part of any balance on any Account used by you and any winnings, funds, rewards or other credits awarded to you, in each case to the extent the relevant transactions/balance/winnings/funds/rewards/credits are attributable to such Prohibited Event;

11.1.2 if we ask you to, you must repay all or part of any such balance, winnings, funds, rewards or other credits that you have withdrawn or used, and any chargebacks, in each case to the extent attributable to such Prohibited Event; and

11.1.3 we may use any such withheld or repaid balance, winnings, funds, rewards or other credits for any reason, including to compensate any Users that may be affected by any Prohibited Event.

11.2 Unacceptable Conduct is a Prohibited Event under Part B Section 13. If we take any of the actions described in Section 11.1 above as a result of us discovering or determining that you have engaged in collusion (collusion is a type of Unethical Play which we explain is Unacceptable Conduct under Part B Section 10), evidence of you and other Users sharing the same device, IP address, residential address, email address, or mobile/Wi-Fi network may be taken into account during our investigation of the Unacceptable Conduct, if relevant under the circumstances.

  1. How we deal with dormant Accounts

If your Account has a positive balance and you have not made any transactions on it for a consecutive period of more than 1 year, then it will be deemed to be "dormant". If your Account is or becomes dormant, we will attempt to repay your balance to the last payment method used by you. If we have been unable to return your balance then we will contact you to let you know and we will ask you to provide an alternative payment method. If you do not provide an alternative payment method (which must be agreed by us in accordance with the General Terms) within 1 year, then your balance will be remitted to the Romanian state budget and your Account will be closed.

  1. Closing your Account for convenience

13.1 You may at any time ask us to close your Account. To do so, please contact us.

13.2 We may close your Account at any time for any reason in our reasonable discretion by giving you reasonable written notice. This does not affect our rights under the General Terms to close your Account for other reasons (such as a change in law or regulation, or if you are involved in a Prohibited Event -- see Part B Section 14 and Part B Section 15).

13.3 As per the in-force legal provisions, we may suspend or close your Account and inform you immediately if: (i) you breach the applicable legal provisions, or (ii) if you fail to comply with the game rules or the present General Terms. If we decide to suspend transfer to or from your Account for the reasons mentioned above, the decision together with the relevant documentation will be communicated to you.

13.4 Part B Section 16 explains that we will return any positive balance on your Account when it is closed for any reason (except your breach of the applicable legal provisions or breach of the General Terms and/or gaming rules). We will do this within 10 business days of the date your Account is closed. If we have been unable to return your balance then we will contact you to let you know and we will ask you to provide an alternative payment method. If you do not respond to this or you do not provide an alternative payment method (which must be agreed by us in accordance with the General Terms) within 1 year, then your balance will be remitted to the Romanian state budget.

INFORMATION ABOUT GAMES AND SERVICES

  1. Placing bets

14.1 You may only place bets up to the value of the cleared funds in your Account.

14.2 Except for Exchange Services, all betting transactions must be conducted online through the Website. For Exchange Services, you may also place bets via the Betfair Exchange application programming interface (' API '), which includes both direct API access and licensed third-party API applications that enable betting on the Exchange Services.

  1. Minimum and maximum bet sizes

15.1 Depending on the type of Services or market you are betting on and the currency that you are betting in, there are minimum bet sizes that apply. These minimum bet sizes are subject to change from time to time. You must not place (or try to place) bets that are below the minimum bet size threshold.

15.2 Maximum bet sizes are as set out in the Sportsbook Rules and Exchange Rules for each of those Services respectively.

  1. Maximum Winnings Limits

16.1 As we made clear in the " Important Note " at the beginning of the General Terms, maximum winnings limits apply to some of our Services and these limits apply regardless of stake and no matter how much you appear to have 'won'. The maximum winnings for each Account are as follows:

16.1.1 Sportsbook. With respect to Sportsbook betting transactions placed through the Services, the maximum payouts to any one User are as set out in the Sportsbook Rules.

16.1.2 Games. With respect to Games played via the Services:

(a) the maximum winnings for any one wager or gameplay transaction are as set out in the applicable rules for the applicable Game as set out on each Game's information page on the Website; and

(b) the maximum cumulative winnings on all Games (excluding any progressive jackpot wins) in any 24-hour period (00.00-23.59) by an individual User is capped at EUR 1,000,000. This means that if your winnings exceed this sum in any 24-hour period then any additional bets or wagers made within the same period will be void and any associated sums bet or wagered by you will be returned to you. If a bet or wager is made by you that takes your total cumulative winnings over the EUR 1,000,000 limit within the 24-hour timeframe you will be paid out up to EUR 1,000,000 and any excess winnings will not be paid to you and, of the original sum bet or wagered, an amount will be returned to you pro rata in relation to the benefit lost.

  1. Bet settlement

17.1 As set out in the Sportsbook Rules and Exchange Rules, we will where appropriate reverse or amend settlement if a market has been settled incorrectly. This may lead to amendments being made to your Account to reflect changes in market settlement and if there are insufficient funds in your Account, we may require that you put funds into your Account to address the outstanding balance. We will let you know if you owe Betfair money and if, following the notification, you either:

17.1.1 do not put funds in your Account within the reasonable time specified in our notice to you;

17.1.2 fail to make the relevant payments into your Account in accordance with any repayment plan as agreed between you and Betfair; or

17.1.3 indicate to Betfair that you have no intention of putting funds in your Account to address the outstanding balance,

then we can set off the positive balance in your Account against amounts that you owe to us. We will also where appropriate take legal action to seek to recover the debt.

17.2 Any amounts settled as winnings or losses will be rounded to the nearest 2 decimal places. This means that if the amount ends in 0.5, it will be rounded up. You must not attempt to place bets which deliberately take advantage of us rounding up to the nearest cent. Bets which seek to do so will be voided.

17.3 Nothing in this Part A Section 17 affects any right we have elsewhere in the General Terms to delay any withdrawal, void any transaction, or recover or not pay out any balance, winnings, funds, rewards or other credits.

  1. Sportsbook and Exchange Rules are not the same

Please note that (as listed in Part A Section 3 above) there are separate rules for each of our Exchange and Sportsbook Services. The rules governing how markets are offered, managed and/or settled are not the same for every market on each of those Services. In certain circumstances, a bet that is settled as a winner on one of them may be settled as a loser on the other (and vice versa). Additionally, different settlement rules may apply so that, for example, bets that are a winner on one of them may be settled as a 'Dead Heat' (as defined in the Sportsbook Rules and Exchange Rules) or voided on the other. You must ensure you familiarise yourself with the relevant rules that apply to the bets you place on Betfair's Services.

  1. Interruptions during Games

19.1 In the event of an Interruption to the Game you are playing:

19.1.1 where an Interruption occurs after we receive notification of your gamble and where you can have no further influence on the outcome of the event or gamble, the results of the gamble will stand;

19.1.2 where an Interruption to a single-participant single stage event occurs before an outcome has been generated we will return your stake to your Account;

19.1.3 for Games where there are multiple stages or decision points we will take all reasonable steps to restore the game to its last known state prior to the Interruption to enable you to complete the game;

19.1.4 for Games with multiple participants (equal chance or otherwise) we will deal with these as seems fairest to us (acting reasonably) on a case-by-case basis; and

19.1.5 for Games that are progressive jackpots, progressive jackpot values will be restored to their pre-failure state to the extent it is within our control and not the control of the Game's provider.

  1. Exchange Games

In order to operate the Exchange Games, we and/or other Flutter Group companies consistently and systematically provide liquidity into Exchange Games markets (in accordance with Betfair's terms and conditions, our relevant operating licences and the approval of the relevant regulating authorities).

23.2 We may suspend, modify, or remove in whole or part and/or add to the Services in our discretion. Where possible this will be on prior notice to you, however some amendments to the Services may need to be made with immediate effect and without notice (for example if any urgent maintenance is required).

  1. We are not responsible for your reliance on Information

24.1 We do not guarantee that the Services or Software will be free from Errors, Malfunctions or Interruptions. Part B Section 9 explains our rights if any Error, Malfunction or Interruption happens to the Services or Software while you are using them.

24.2 Without affecting what we say in Section 25.1 above:

24.2.1 from time-to-time we provide you with access to various information and content (' Information '), including form data, results, video streaming, upcoming events, the times and dates of events, current scores, time elapsed, and other information relating to a sporting event. Information may be provided by Betfair or sourced from a third party and may be supplied via the Website (including micro-sites and as part of any runner data and/or results service), any available telephone betting Services, emails, messages and/or other means of communication;

24.2.2 although some Information may be described as "live", or it may be implied that such Information is "live", this Information may be subject to a time delay; and

24.2.3 other Betfair customers may have access to pictures and/or data that is faster and/or more accurate than the Information.

We do not guarantee that Information is accurate, complete, current or free from Errors. If you rely on any Information to make decisions about and place bets, you do so entirely at your own risk. We are not responsible for the accuracy, completeness or currency (or lack thereof) of any Information or for any loss arising from your reliance on Information.

24.3 Links to third party websites provided by Betfair do not constitute an endorsement by Betfair of any products or services available on or via such websites. You use such websites at your own risk and Betfair is not responsible for the content on, or use of, such websites.

24.4 Nothing in this Part A Section 24 affects our responsibility under Part B Section 18.1 of the General Terms or the liability provisions set out in Part A Section 26 of the General Terms.

  1. You are responsible for information you provide to us

You are responsible for the information that you provide to us concerning the offer that you wish to place via the Services, and for ensuring that the details of your bet are correct. We are not responsible for incorrect entries made by you, including data input Errors with respect to the odds, price or stake on offer.

OTHER LEGAL RESPONSIBILITY

  1. Our overall maximum liability to you

26.1 Except under Part B Section 18.1 of the General Terms and save in respect of any winnings lawfully due to you, our maximum liability to you under the General Terms in relation to any one incident or series of related incidents is limited to: (a) where such liability relates to a specific stake, bet or wager, the value of such stake, bet or wager paid by you (including when we are required to return to you the specific stake, bet or wager as a result of an unavailability of the Services that cannot be attributed to you); (b) where such liability relates to the misapplication by us of funds in your Account, the amount that has been lost or misplaced by us; or (c) in any other case the amount of the actual damage or loss you can prove you have incurred.

26.2 We do not owe you, and will not be liable to you under, a duty of care related to our compliance or non-compliance with any regulatory obligations that we may be under from time to time including those relating to 'safer gambling' or 'social responsibility'.

  1. Governing law and jurisdiction

27.1 The General Terms are governed by the laws of Romania and the courts of Romania will have exclusive jurisdiction in relation to any claim, dispute or difference concerning the General Terms and any matter arising under them. You waive any right that you may have to object to an action being brought in those courts, or to claim that the action has been brought in an inconvenient forum, or that those courts do not have jurisdiction.

27.2 Despite what we say in Part A Section 27.1 above, nothing in the General Terms affects either: (a) any rights granted to you as a consumer under mandatory provisions of any law applicable to you; or (b) our right to take proceedings against you in any court of competent jurisdiction, nor will the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.

  1. Prevailing language

The Romanian language version of the General Terms will take precedence over any versions of the General Terms in other languages.

  1. Assignment and Transfer

29.1 We may assign and/or transfer, in whole or in part, any of our rights and/or obligations under these General Terms to another company within the Flutter Group or to any other legal entity, including as part of a merger, corporate restructuring, or business sale. Any such assignment or transfer will be carried out under terms that are not less favorable to you.

29.2 By accepting the General Terms, you expressly consent in advance to any such assignment and/or transfer, without the need for additional approval at the time of transfer. In the event of such an assignment and/or transfer, all rights and defenses you have under these General Terms, including those related to your consent and any other contractual exceptions, will remain intact and will be transferred as such to the third party assuming our rights and obligations.

29.3 You will be notified in advance of any such assignment and/or transfer via e-mail, an in-account notification (pop-up), or any other available communication channel (including the phone number registered to your Account). The transfer will become effective either upon your receipt of such notification or upon your continued use of the Services, including by maintaining your Account active on the platform, logging into your Account, or engaging in any transactions through the Website or Gaming Platform.

29.4 Part B Section 20.2 of the General Terms is replaced and superseded by this Part A Section 29 and will not apply to you under the General Terms.

PART B: TERMS APPLICABLE TO ALL BETFAIR INTERNATIONAL SITES

SETTING UP YOUR ACCOUNT

  1. How to register an Account

1.1 You need to register an Account to use certain Services. You can do this by clicking "Join Now" and following the on-screen instructions.

1.2 We are under no obligation to open any Account. We may refuse to open an Account for any reason (including failure to meet any Account Requirements).

  1. Account security and your choice of username

2.1 You must keep your username(s), password and (if available on the Website) any telephone account number (' TAN ') (' Login Credentials' ) strictly confidential and not disclose them to anyone else. We are entitled to assume that any activity occurring under/using your Account or Login Credentials is undertaken or authorised by you. You are solely responsible for all use of the Services via your Account or using your Login Credentials, including any gambling losses, whether authorised by you or not. (unless such use is directly caused by our failure to exercise reasonable care and skill). You must tell us about any unauthorised use of your Login Credentials or Account as soon as you suspect or become aware of it.

2.2 Please note that when you register an Account you have the option to use your email address or a username to log in to/identify your Account. You should keep in mind that the use of email addresses as usernames can reduce the security levels of your Account as your email address may be more accessible and this makes it easier for third parties to gain access to your Account. We recommend that you use a strong password, and you change it on a regular basis.

2.3 Any username or nickname/alias or other name and any avatar or image you choose to use in connection with the Services (if such options are available on the Website) must not include any Unauthorised Content. Betfair may amend any item that includes Unauthorised Content (this does not affect any other rights we have under the General Terms such as our ability to treat the posting or sharing of Unauthorised Content as a Prohibited Event). You grant Betfair, for the benefit of Flutter Group, a worldwide, irrevocable, transferable, royalty free, sublicensable license to use these items for any purpose connected with the Services.

  1. Duplicate Accounts

3.1 You may only open one Account with Betfair. If you open more than one Account, each such additional Account will be classified as a ' Duplicate Account '.

3.2 If we discover that you hold one or more Duplicate Accounts, we will (in respect of each Duplicate Account)

close the Duplicate Account(s) or the original Account (as applicable), leaving you with only one Account (unless we have reason -- for example if you have deliberately or fraudulently opened more than one Account -- to close all of your Accounts).

3.3 If we discover or have reason to believe that you have deliberately or fraudulently opened or are using one or more Duplicate Accounts, then that will be a Prohibited Event and we will close all your Accounts and take other appropriate action as set out in Part B Section 14 and Part A Section 11.

HOW YOUR FUNDS ARE MANAGED

  1. Deposits

4.1 With respect to deposits, you must:

4.1.1 make deposits to your Account using a payment card, account or wallet that is held in your own personal name;

4.1.2 if requested, prove that the name on the payment card, account or wallet used to make deposits corresponds to the name used for your Account;

4.1.3 be the rightful owner of the money which you deposit in your Account;

4.1.4 not deposit any money into your Account which originates from criminal or other unlawful or illegal activities, or use such money to make transactions via the Services; and

4.1.5 without limiting any of the above, not use a stolen, cloned or otherwise unauthorised payment method as a source of funds in connection with your Account or any transactions made via the Services.

These are the ' Deposit Requirements '.

4.2 Your deposit will be available in your Account as soon as your bank or other payment method authorises the amount you choose to deposit. We give no guarantees about the amount of time needed to complete that processing, because it is an Event Beyond Our Control.

  1. Balances

5.1 Account balances are kept in segregated accounts and are not used by us for operational expenses. This ensures that your funds are always available for you to withdraw in accordance with our banking and security policies and procedures, our license requirements, best practice, and the General Terms.

5.2 We are not a bank or financial institution, and you must not treat us at such. Monies deposited with us will not accrue interest and we do not offer any credit.

  1. Charges, commission and payment structure

6.1 There is no charge for downloading Software, accessing the Website, or registering an Account.

6.2 The costs of using certain Exchange Services are set out the 'Betfair Charges' section of the Website.

  1. Winnings and taxes

7.1 Unless (and to the extent) stated otherwise in Part A Section 11:

7.1.1 Subject to the General Terms (including any right we have under the General Terms to void any transactions and recover or not pay out any balance, winnings, funds, rewards or other credits), we will credit your Account with your winnings as soon as practicable*.*

7.1.2 You are solely responsible for reporting your winnings and losses if required by any law, regulation or relevant authority (including any tax authority) applicable to you, and for paying any taxes that may be payable on any funds or prizes awarded to you through your use of the Services. We do not provide advice about tax regulatory or legal matters. If you need any such advice, you should contact appropriate advisors and/or authorities independently.

7.2 If any sales or value-added tax applies to any payments made by you in connection with your use of the Services, such payments shall be treated as inclusive of all such tax.

  1. How withdrawals and returns are processed

8.1 Each withdrawal request, and any return to you of funds, will be processed so long as:

8.1.1 all payments made into your Account have been confirmed as cleared and are not the subject of any chargeback, reversal or other cancellation claim; and

8.1.2 there is no ongoing (or, where applicable, completed) investigation into:

a) any Error, Malfunction or Interruption related to your use of the Services; or

b) your involvement in any Prohibited Event.

8.2 If there is an ongoing investigation into any Error, Malfunction or Interruption or suspected Prohibited Event related to your use of the Services, the withdrawal will not go through unless and until the investigation has been resolved to our reasonable satisfaction. Part B Section 9 explains when we will void transactions and recover or not pay out winnings, funds, rewards or other credits resulting from any Error, Malfunction or Interruption related to your use of the Services. Part B Section 14 and Part A Section 11 explain when we will restrict, suspend or close your Account or void transactions and recover or not pay out winnings, funds, rewards or other credits attributable to any Prohibited Event. You should read these sections carefully and ensure you understand what they mean for you.

8.3 You acknowledge that any delay in providing information we ask for in connection with any investigation may result in a delay to the processing time for the withdrawal or return.

HOW WE DEAL WITH ERRORS, MALFUNCTIONS AND INTERRUPTIONS

  1. Errors, Malfunctions and Interruptions - when we will void transactions and recover or not pay winnings

9.1 Errors, Malfunctions or Interruptions in the Services or Software may or may not be apparent to us or to you at the time, and they may only come to light as and when settlement instructions, bet and where available, Game outcomes, winnings or withdrawal requests are investigated and analysed by us retrospectively. You must not abuse or take advantage of any Error, Malfunction or Interruption which is or becomes apparent to you (for example by exploiting it to obtain winnings). If any Error, Malfunction or Interruption is or becomes apparent to you, or you suspect that it may be occurring to any part of the Services you are using, you must stop using that part of the Services immediately and tell us about it.

9.2 You must provide any information we reasonably require in connection with any investigation into any Error, Malfunction, or Interruption.

9.3 If, as a result of an Error, Malfunction or Interruption in the Services, your Account is credited with winnings, funds, rewards and/or other credits that you would not have received were it not for that Error, Malfunction or Interruption (" Erroneous Credits "), we will void the relevant transaction(s) and withhold or recover the Erroneous Credits. This applies even if the relevant part of the Services could have produced the same or similar amount of winnings/funds/rewards/credits absent the Error, Malfunction or Interruption and applies whether or not the Error, Malfunction or Interruption was apparent to you or to us at the time. If you have withdrawn any Erroneous Credits, you must pay them back to us as and when we ask you to.

9.4 Your playing/betting session may be "timed out" due to inactivity. It is your responsibility not to leave your session unattended/inactive.

YOUR USE OF THE SERVICES

  1. What we mean by 'Unacceptable Conduct'

10.1 You must only use the Services (including any Information gained through them and any content on them) in accordance with their intended functionality and the General Terms. Use of the Services outside these parameters is a serious breach of the General Terms and therefore a Prohibited Event.

10.2 You must not:

10.2.1 engage in any behaviour when using the Services which: (a) is abusive, offensive, malicious, threatening, harassing, insulting, intimidatory, defamatory, racist, discriminatory or otherwise inappropriate (including when playing any available Games or waiting for other Users to make a move in a Game, and in your general interactions with our staff or other Users); (b) is intentionally disruptive (for example by sending multiple and frequent messages to drown out legitimate chat (''flooding''); or (c) could otherwise cause distress, harm or inconvenience to any other person;

10.2.2 use the Services or Software in any way which is fraudulent, dishonest, unlawful, illegal or criminal, or may lead to the encouragement, procurement or carrying out of any fraudulent, dishonest, unlawful, illegal or criminal activity;

10.2.3 be involved in any Suspicious Betting or Unethical Play;

10.2.4 use any Prohibited Tools and Services;

10.2.5 directly or indirectly use more than one account (whether an Account or any other Flutter Group account) in the same player or prize pool at the same time, whether any play activity actually occurs on any such account or not (this does not affect anything we say elsewhere in the General Terms about Duplicate Accounts);

10.2.6 after elimination from any tournament or prize pool, directly or indirectly re-join the tournament or prize pool using a different Account or any other Flutter Group account;

10.2.7 post or share any Unauthorised Content via any chat facilities or any other part of the Services, or in any correspondence to us;

10.2.8 attempt to bypass any filters we apply to any chat facilities on the Services (for example if we asterisk out profanities and other unacceptable words) or any changes we make to any username, nickname/alias or other name, avatar or image used by you in connection with the Services;

10.2.9 make any public statement about any part of the Services or any company in Flutter Group which is untrue or malicious or do anything which could damage the image or reputation of any part of the Services or any company in Flutter Group;

10.2.10 use any part of the Services (including any information gained through them or any content on them) or any Software for commercial or business purposes (use for commercial/business purposes includes any use by a betting operator or any use by an individual or organisation supplying data or services to a betting operator); or

10.2.11 attempt to do any of the things listed in Sections 10.1.1 to 10.1.10 above.

Each of these actions is " Unacceptable Conduct ".

10.3 We may (in addition to our other rights) take steps to detect and prevent the use of Prohibited Tools and Services. You must not attempt to bypass, interfere with, or block such steps in any way, whether by using software designed for the purpose or otherwise (to do so would be a serious breach of the General Terms and therefore a Prohibited Event).

  1. Suspicious Betting

11.1 ' Suspicious Betting ' is when we discover or have reason to believe that a single or number of bets have been placed in suspicious circumstances. Suspicious circumstances include:

11.1.1 where there is an excessive frequency and/or highly unusual pattern of bets (when compared with betting norms) placed on the same selection(s) in a short space of time;

11.1.2 where there is an excessive frequency and/or highly unusual pattern of bets placed on the same selection(s) and where the theoretical probability of said selection(s) winning at the time of bet(s) placement, based on the odds offered at the time of bet placement, is largely inconsistent with the theoretical probability of the same selection(s) winning calculated using their starting prices. For example, an inordinately large number of bets placed on a multiple or permutation with combined odds of 250/1 (with a theoretical 0.004% probability of winning based on the odds) when the same multiple or permutation had combined odds of 12/1 based on the starting prices of the selections (a theoretical 7.7% probability of winning);

11.1.3 where the integrity of one or more events has been called into question, including where one (or more) of the participants in an event displays exceptional form which we discover or have reason to believe was known to you, or someone connected to you, at the time you placed the bet, and that information was concealed from the public generally in order to gain an unfair advantage in any bets placed on that event(s);

11.1.4 where we discover or have reason to believe that a bet or a string of connected bets were placed using Prohibited Tools and Services);

11.1.5 where we discover or have reason to believe you have used unfair external factors or influences connected with the event(s) which are the subject of any bet(s);

11.1.6 where we discover or have reason to believe that you have opened one or more Duplicate Accounts, or that any other Accounts are under common control with your Account, with a view to concealing the true worth, nature or pattern of bets placed by you or on your behalf. This applies even if the other Accounts are opened under different names and does not affect anything we say elsewhere in the General Terms about Duplicate Accounts;

11.1.7 where we discover or have reason to believe that you are acting in connection with others;

11.1.8 where we discover or have reason to believe that bets have been placed from a location or device other than the location or device which you claim to have used to place a bet. This does not affect anything we say in Part A Section 8; and

11.1.9 where we identify a pattern of bets that have been placed in quick succession by different or the same Account holder(s) that have a combined liability which exceeds what we would expect to accrue on similar bets during a particular time period based on long term established betting trends. For example, we would regard a series of bets placed on the same or similar selections in quick succession after 9:30pm and before 8:00am by different Accounts with a combined liability that exceeds GBP 100,000 (or local currency equivalent) as suspicious as this conflicts with our long term established betting trends.

  1. Our intellectual property and what we mean by 'Unauthorised Use'

12.1 We are proud of the products and services we have created and which we make available to you, and it's important to us (and our licensors) to protect them. This license is granted for your private personal use only.

12.3.3 extract any Software from the Services;

12.3.4 sell, assign, sublicense, transfer, distribute or lease any Software or any part of the Services;

12.3.5 make any Software or any part of the Services available to any third party through a computer network or otherwise;

12.3.6 export any Software or any part of the Services to any country (whether by physical or electronic means);

12.3.7 attempt to gain unauthorised access to the Website or Gaming Platform, the servers on which the Website/Gaming Platform are stored, or any server computer or database connected to the Website or Gaming Platform;

12.3.8 use our trademarks, content or other intellectual property without our express, written permission; or

12.3.9 attempt or assist anyone else to do any of the things listed in Sections 12.3.1 to 12.3.8 above.

Each of these actions is an " Unauthorised Use ".

13.1.4 if you deliberately or fraudulently open or are using one or more Duplicate Accounts;

13.1.5 if we discover or have reason to believe that you are accessing or attempting to access the Services from any of the Prohibited Territories;

13.1.7 if we discover or have reason to believe you have allowed (whether intentionally or unintentionally) someone else to use your Account;

13.1.8 if we discover or have reason to believe you have intentionally or unintentionally used someone else's Account (for example you have used someone else's Account without their permission);

13.1.9 if at any time you do not meet or fail to comply with any of the Deposit Requirements;

13.1.10 if we receive a fraudulent chargeback and/or return notification via a payment method used on your Account;

13.1.11 if we discover or have reason to believe you are or have been depositing or withdrawing money or otherwise using the Services without genuine play;

13.1.12 if we discover or have reason to believe you have abused or taken advantage of any Error, Malfunction or Interruption;

13.1.13 if we discover or have reason to believe that you have engaged in any Unacceptable Conduct;

13.1.14 if you make or attempt to make a bet when your Account contains insufficient cleared funds;

13.1.16 if you place a bet on any sporting match or event in which you take part;

13.1.17 if you place a bet on or manipulate any individual market in a manner which we believe (acting reasonably) has the purpose or effect of adversely affecting the integrity of the Exchange or any market;

13.1.18 if you transmit or provide any information or otherwise engage in any activity (such as, for example, so-called "courtsiding") that assists a third party in the placing of bets on any sporting event or contest whilst you are located in any territory where it is illegal to place such bets;

13.1.19 if you procure or arrange for a third party to transmit or provide information or otherwise engage in any activity (such as, for example, so-called "courtsiding") that assists in the placing of bets on any sporting event or contest whilst such third party is located in any territory where it is illegal to place such bets;

13.1.20 if you intentionally match Exchange bets against your own Account (or any related account) with the intention of adversely affecting or manipulating a market for your (or a related account's) benefit;

13.1.21 if you attempt to use the Exchange to deliberately transfer money from one Account to another by attempting to match bets on a market with another Account through collusion;

13.1.22 if we discover or have reason to believe that you have engaged in any Unauthorised Use;

13.1.23 if you breach any part(s) of the General Terms in some other serious way (we give some examples of serious breaches throughout the General Terms -- see Part B Sections 10.1 and 10.3 -- but these are not the only ways serious breaches could occur), or you repeatedly breach any part(s) of the General Terms in such a way as to reasonably justify the opinion that your conduct is inconsistent with you having the intention or ability to give effect to the General Terms.

13.2 You must tell us straight away if you suspect or become aware that any Prohibited Event has been or is being committed by any User, and reasonably assist us with any investigation into any Prohibited Event (including by providing any information we reasonably request).

ACCOUNT CLOSURE, RESTRICTION AND SUSPENSION

  1. When we will restrict, suspend or close your Account for Prohibited Events

14.1 We will restrict or suspend your Account, your ability to bet, play Games (where available), and/or any other aspect of your access to or use of the Services, where we have reason to believe that you have been involved, or are likely to be involved,in a Prohibited Event.

A "restriction" is where a limitation is placed on your access to or use of a particular product, feature or part of the Services or your Account.

A "suspension" is where you are temporarily prevented from accessing your Account or the Services as a whole.

14.2 Your use of the Services/Account will remain restricted/suspended while the matter is investigated and/or until our checks have been completed. If the investigation results in our decision (acting reasonably) that the issue has been resolved to our satisfaction, we will lift the restrictions/suspension (either in full or in part). However, if the investigation results in our decision (acting reasonably) that you have been involved in any Prohibited Event, then we will permanently restrict or close your use of the Services/Account.

14.3 If we restrict, suspend or close your use of the Services/Account under this Section 14 then:

14.3.1 we may notify other companies in Flutter Group and any account(s) you hold with them may also be restricted, suspended or closed;

14.3.2 you may be temporarily or permanently excluded from access to services/products offered by other companies in Flutter Group (including live events where applicable); and

14.3.3 we will if appropriate report you to the relevant authorities or other third parties, and/or take legal action against you.

14.4 Your funds cannot be accessed or withdrawn during periods of suspension, and any balance will remain in your Account.

14.5 If you have engaged in any illegal activity, we are under no obligation to permit you to withdraw or return to you any funds in your Account.

  1. Other ways your Account can be restricted, suspended or closed by us for cause

We will restrict, suspend or close your Account, the Services (in full or part) or your access to or use of them, if required for legal or regulatory reasons or if we reasonably believe there to be a security risk.

  1. What happens when your Account is closed for any reason

You remain responsible for activities using your Account until it is closed. We will tell you when your Account will be closed and we will return any positive balance on your Account at that time, unless we have a right to delay the return, void any related transactions, or recover or not pay out any balance, winnings, funds, rewards or other credits under the General Terms.

WHEN WE ARE NOT RESPONSIBLE AND WHEN YOU MUST COMPENSATE US

For example, we are not responsible if your connection or equipment is slower than other Users', and it affects your performance in time critical products.

17.3 We may suspend or cancel all or any part of the Services if, despite making reasonable efforts to do so, we are not able to provide the Services or any part of them due to any Event Beyond Our Control.

18.1 Nothing in the General Terms excludes or limits our responsibility for:

18.1.1 our fraud or fraudulent misrepresentation;

18.1.2 death or personal injury resulting from our negligence or the negligence of our employees or agents; or

18.2.1 that could not have been reasonably expected by you and us at the time you register your Account or enter into a transaction on the Services. In all circumstances this includes any loss of income, business, savings or profits;

18.2.4 arising from any Prohibited Event;

18.2.5 arising from your use of any Permitted Tools and Services;

18.2.6 arising from any Error, Malfunction or Interruption; or

18.3 You must compensate us for any costs, charges or losses sustained or incurred by us arising from your participation in a Prohibited Event.

18.4 If there is a cap on our total liability to you, or your liability to us, it will be set out in Part A. Any such cap(s) on liability will not affect our responsibility under Section 18.1 above.
